Not All Renewable Energy Lease Buyouts Are The Same

The number of renewable energy projects has expanded over the last several years and so too has the number of landowners with valuable solar and wind leases. In response to this uptick there are a growing number of companies whose expertise is landowner lease monetization in the oil & gas, cell tower and/or billboard segments who are changing lanes to respond to the renewable energy boom.

One important difference between solar/wind leases and those executed for other land uses, is that the standard in other industries (cell tower, oil & gas, and billboards) is to require a perpetual or 99-year easement agreement as collateral against lease payments. The newcomers don’t understand the nuances of renewable energy leases, and that therefore when buyout agreements are structured, there is no need for landowners to grant any property rights, however they require them and often do not divulge them to landowners until closing, MSE requires no easement.
